Retired President Daniel Moi on Thursday, May 16, suffered a major blow after he lost a case at the High Court.
High Court Judge Antony Ombwayo ordered Mzee Moi to pay Susan Cheburet Chelugui, and her son David Chelugui Sh1bn for illegally acquiring their land.
"Acquisition of the said properties by the 1st and 2nd respondents were arbitrary unconstitutional, irregular, unprocedural, tainted, a nullity ab initio and therefore not worthy of any constitutional protection.
"The 1st and 2nd respondents do pay and are hereby ordered to pay the estate of the Late Noah K. Chelugui the prompt payment in full of just and current market value of the said properties….,” said the judge as quoted by Citizen Digital.
The widow moved to court accusing Moi of grabbing her 53 acres of land valued at over three billion shillings, located in Uasin Gishu.
Moi reportedly grabbed the land in March 2007.
According to court papers filed in 2014, the widow, now 92, said the land belonged to her late husband Noah Chelugui.
Her lawyer accused Moi of taking the land and selling it to Rai Plywood Ltd, which is now in possession of the land.
In 2014, lawyer William Arusei, who was representing the widow, told an Eldoret court that Moi used a Mr Stanley Metto to get the title of the land from the widow’s late husband.
Metto reportedly told the late Noah Chelugui that he would help him sell the land; when he got hold of the title, but that never happened.
