After the 2013 general elections, Matungulu MP Stephen Mule was a happy man when he was declared the victor in the parliamentary race.

Four months later, his happiness was short lived after the Machakos High Court nullified his elections and ordered for a fresh poll.

The court ruled that there were electoral irregularities, it ruled that Mule was not validly elected.

The sitting judge Lilian Mutende observed that only a by-election would solve the situation at hand.

The poll petitioners John Makenzi, Thomas Masau, Stephen Ndambuki and Moffat Maitha had filed a petition after the election complaining that their agents were not allowed access to the tallying centre.

They also claimed that some polling stations were opened late and closed early thus denying their supporters a chance to exercise their constitutional right.

The court ordered for a recount of the votes in which Mule emerged the winner but the court insisted on a by-election.

Three months later, a by election was held with three candidates on the ballot.

When results were read, Mule trounced his opponents yet again retaining his seat after garnering 11,639 votes.
