Amina Mohamed, the Former Education CS was keen on involving law enforcement agencies to pursue defaulters of the Higher Education Loans Board.

Defaulters owe the government close to Sh 7.4B. HELB has disbursed loans to more than 700,000 students since its inception in 1995.

According to Benson Nyanyuki, a Kisii youth and a degree graduate from JKUAT, defaulters should not be arrested because the act of neglecting to pay loans is a civil matter and not a criminal matter. 

Nyanyuki said that the step of arresting defaulters is nowhere mentioned in the Kenyan Constitution.

Nancy Moraa a University graduate condemned the act of involving the police in tracking down the loan defaulters.

“This is a punitive measure towards the youths of the country since a significant number remains unemployed,” Moraa said in aggression.

Moraa advised the government to first ensure that, it creates job opportunities to them before moving in to arrest them for not repaying the loan.
