Garissa Township MP Aden Duale has accused Chief Justice David Maraga of allegedly violating the constitutional rights of Muslims.

Duale alleges that the CJ has failed to protect the constitutional rights of Muslims.

According to Duale, the Supreme Court ruling that gave schools discretion to decide on wearing of hijabs by Muslim students is unconstitutional.

Duale said that hijab is a religious practice among Muslims and should be respected just the way other practices are respected.

"The Supreme Court ruling on hijabs is discriminative and CJ Maraga should know that we are not happy at all," he said.

Duale who spoke at the NEP College of Health Sciences in Garissa on Saturday said that they will not allow anyone to compromise with their religion.

He asked Muslim girls not to panic, noting that they are strategising on the next course of action.

The Supreme Court ruling on hijabs has elicited debate among Muslim leaders.

On Thursday last week, the apex court overturned a Court of Appeal's ruling that had okayed wearing of hijabs by female Muslim students.

The Supreme Court gave schools powers to decide on its dressing code meaning that they (schools) will decide on whether to allow the wearing of hijabs or not.
