A Kiambu resident has filed a petition in court seeking to have Deputy Governor James Nyoro allocated more executive powers.
James Gacheru wants Nyoro to be allowed to fully take over from embattled Governor Ferdinand Waititu, who remains locked out of his offices over corruption allegations.
In his petition at the High Court, Gacheru also wants Nyoro to be allowed to fully make and enforce decisions touching on human resource management.
He argued that there is need for Nyoro to be able to account for the management of county resources, which he cannot do in his current ceremonial state.
Consequently, he wants an inconsistent declaration of section 32(4) of the County Government Act No17 which says; "When acting as contemplated in Article 179(5) of the Constitution, the deputy governor shall not exercise any powers of the governor, to nominate, appoint or dismiss, that are assigned to the governor under the Constitution."
The petition which has listed Attorney General Kihara Kariuki as a respondent, and Waititu an interested party, comes a few weeks after another resident, Bernard Mburu, petitioned to have Nyoro locked out of power.
Mburu claimed Nyoro is a power hungry person out to capitalise on Waititu's woes to take over.
“There is no law that allows him to be the acting governor and start issuing directives through executive powers he does not have. His decisions are a recipe for chaos since they do not have the blessings of the elected governor," Mburu's petition read in part.
Mr Gacheru's petition will be considered on October 4.
