While delivering the ruling, Justice Isaac Lenaola said that the election of Owino reflects the will of the people of Embakasi East.

Owino's election was nullified in March after High Court Judge Joseph Sergon ruled that the election was marred by all form of illegalities and irregularities.

The Judge ruled that the Jubilee candidate Francis Mureithi had demonstrated the whole exercise was compromised by violence and other illegal acts.

Babu Owino, however, appealed the decision at the Court of Appeal which reinstated his win forcing Mureithi to move to the apex court.

The decision by the Supreme Court is final and the former University of Nairobi students leader will now continue serving as the Embakasi East MP.
