A court on Wednesday ruled in the favour of a trader who had sued Postal Corporation of Kenya, popularly known as Posta Kenya, for breach of contract.

The trader is now set to receive Sh20 million after the firm failed to honour a lease agreement of a piece of land located in Thika.

Jerald Kamondo Njuki will receive the compensation after he traded with Posta under his firm Geka General Supplies.

He was demanding Sh205 million as compensation but the court ruled that he did not incur any expenses in developing the plot.

While delivering her ruling, High Court commercial division judge Rachel Ng’etich said that she was convinced beyond doubt Posta Kenya breached the contract of operation.

“This court finds that lawyer Titus Koceyo has established there was a breach of contract as Geka General Supplies never entered into a two-acre plot leased to it three years ago by PCK,” Justice Ng’etich ruled, as quoted by Daily Nation.

The amount is also subject to rates from the courts. 

The court also ordered Posta Kenya to pay costs of the litigation.
