The Kenyan government has been directed by the High Court to facilitate lawyer Miguna Miguna's return into the country tomorrow.
The court has ordered immigration authorities to ensure Miguna gets his passport or a copy of it.
"An order be and is hereby issued, that pending and following the inter-parties hearing of the application, compelling the respondents to facilitate entry of the Petitioner into Kenya on January 7, 2020 or any other date appointed by the petitioner on the basis of his identification through the use of his National Identity Card, or his Kenya Passport in the form and state it was delivered by the respondents to the High Court Registry pursuant to this Court’s Order,” the order read as quoted by Citizen.
While delivering the ruling, Justice Weldon Korir noted that Miguna's lawyer and the Kenya National Human Rights Commission should be granted unlimited access to Miguna upon his arrival.
Reacting to the ruling Mugina said: "Court orders issued today. 1) Miguna Miguna to enter Kenya inconditionally.2) Miguna's ID card enough for entering Kenya.3) The KNCHR to present Miguna's Kenya Passort No. A116842 at immigration for identity purposes.4. Full access by advocates and KNCHR at Immigration."
Miguna was deported to Canada in 2018, after a standoff with immigration authorities.
He has long challenged his deportation in the courts, arguing that it was a violation of his rights as a Kenyan.
