Walter Nyambati, the former Kitutu Masaba MP, has reportedly given up after losing an appeal against governor John Nyagarama on Thursday.
Appeals Court sitting in Kisumu ruled that issues raised by Nyambati did not have effect on the final tally.
A source who spoke in confidence said that the Jubilee party Strategist will not move to Supreme Court as earlier indicated by a section of his loyalists.
"He is now exhausted and will change tact. I have spoken with him and I don't think he's interested.
"Supreme Court will not be his option. He will however continue serving his people," said the source.
On Wednesday, one of the lawyers, Justus Maeche, revealed that they'd move to Supreme Court should he lose the appeal.
During 2017 polls, Nyambati led President Uhuru Kenyatta's campaigns and he lost just by 6,500 votes in gubernatorial election.
