A Kakamega man has sued Attorney General Paul Kihara and the Kakamega county land registrar in a land grabbing case.

Lawyer Anthony Milimu Lubellah claims that the county government has encroached into his land despite having a 99-year lease, and is also demanding land rates from him.

He says that the land, which was allotted to him in 1992, has been annexed to Bukhungu Stadium, which has consequently seen him stop paying land rates,

He further noted that the county has enlisted him among land rate defaulters, and wants the court to order the respondents to dismantle the wall around the land.

Lubellah wants the court to issue an order directing Kihara and the registrar to return his land, which he says the county has refused to survey even after he paid for the same.

The complainant says that the plot; Kakamega Municipality/ Block 111/2 was allotted to him by the Commissioner of Lands in 1992, at a cost of Sh138, 233. 35, adding that he has a lease certificate.

The case was filed before Kakamega Environment and Lands Court Judge Nelly Matheka.

However, in response, the county said that the lawyer owes the county Sh11,855,319.19 in land rates.

It also argues that Mr Lubellah failed to meet the lease conditions after the acquisition, and is yet to develop the land as dictated in the lease 25 years down the line, hence the takeover.
