Samwel Odhiambo was arrested on February 6 and taken to the Usenge Police Station over allegations of raping his neighbour in Central Yimbo location, Siaya county.

He died on February 11 while being treated at the Bondo Sub County Hospital with the police claiming that he got the injuries after attempting to jump out of s moving vehicle while being taken to court.

Speaking on Tuesday, the former Prime Minister asked the Independent Policing Oversight Authority (IPOA) to prove the incident and bring out the truth.

“I am shocked to learn that Odhiambo, who was being escorted to court, is dead and yet the police cannot prove that the deceased jumped out of the moving vehicle. Only a proper probe will reveal the cause of death of the suspect,” he told the People Daily.

According to Charles Otieno, brother to the deceased, they spoke for the last time on Monday when the Odhiambo notified him that he was being taken to court.

He claims that the case was not determined in court due to the prosecution's failure to provide a P3 for the purported rape victim.

"We’re told the court refused to register the case due to lack of a P3 form from the complainant," said Otieno.
