Lawyer Miguna Miguna has accused ODM Leader Raila Odinga of subverting the constitution after he asked Members of Parliament to approve the appointment of Mwende Mwinzi as Kenyan ambassador to South Korea.

Miguna argues that he was blocked from returning to Kenya yet he is a citizen and Raila kept quiet only to defend Mwinzi. 

He noted that Mwinzi is an American by birth and doesn’t deserve to be given the post.

“Mwende Mwinzi is an American-born citizen whom the Constitution bars from holding STATE OFFICE because ambassadors represent the STATE and GOVERNMENT. Stop subverting the Constitution," Miguna tweeted.

On Saturday, Raila said that the lawmakers are wrong to insist that Mwinzi should denounce her US Citizenship before she can assume office following her appointment by President Uhuru Kenyatta.

 He faulted the MPs for maintaining that Mwinzi cannot assume office unless she drops her US citizenship. 

Raila also said that Mwinzi is a US Citizen by the fact that she was born there and not applied for the same.

“She cannot denounce any because both have been acquired not by application and naturalization but by operation of the law,” the ODM leader was quoted by Citizen Digital.

The National Assembly Majority Leader Aden Duale has maintained that Parliament will only allow Mwinzi to assume her new role after she ceases to be an American. 

He reiterates that the constitution is very clear on the matters of citizenship and parliament is right on the same. 

Mwinzi has since sought legal redress after her appointment was put on hold.
