The Director of Public Prosecution Noordin Haji has insisted that city lawyer Assa Nyakundi murdered his son.
In new evidence, Haji now alleges that there are possibilities that the lawyer murdered his son after directly shooting his son on the chest.
The DPP now says the move to charge the lawyer with murder is justifiable.
The office of the DPP has also accused the family of the suspect of attempting to cover the story and let him walk away with murder.
He insisted that they have been doing everything within their reach to ensure that their kin is not prosecuted for the mysterious death of his son 29-year-old son Joseph Bogonko Nyakundi at their Muthaiga home in Nairobi on March 17.
“Nyakundi’s claim that the firearm accidentally discharged while he was picking it from its holster could not stand and after ballistic examination, there is evidence of direct shooting by aiming at the deceased chest,” said the DPP, as quoted by Standard.
DPP has also said that the manslaughter case against the lawyer was a clear denial of justice to the deceased.
He said that the man should be charged in Nairobi where the offense had taken place and not Kiambu. On his part, Nyakundi has insisted that he is innocent.
The lawyer is expeted to appear before Justice Jessie Lessit on July 18 for the hearing of the case.
