The Eldoret High Court will on June 17, 2019, determine whether Naftali Njoroge who is accused of murdering the late Ivy Wangechi (a Moi University medical student) will be released on bail or not.
According to Njoroge's lawyer Mbiyu Kamau, the accused side has already presented their application for bail which is in accordance with the law.
“The matter of bail is a matter of right because it is provided for in the constitution, and our criminal procedure code.
“It is for every person in Kenya who is suspected to have committed an offense to be granted bail, unless there are compelling reasons which have to be tangible, strong, and convincing to the court that the accused person should be denied his right to bail,” Kamau told the media outside Eldoret High Court.
He further noted that the bail ruling will be delivered on June 17, 2019, adding that it’s the discretion of the judge to either deny or grant bail in accordance with the law.
Kamau, however, said the bail can only be denied if the accused person comes to court and admits being guilty.
