Candidates scouting for the appointment as independent directors to the Communication Authority board (CA) will wait longer after the High Court halted the process.
While issuing the directive on Monday, Justice Maureen Onyango said that the right legal procedures were not followed during the process of appointment.
He asked Information and Communication Technology (ICT) Cabinet Secretary Joe Mucheru to revisit the process for the sake of transparency as well as accountable at the end of the day.
The new move comes after activist Okiya Omatatah filed a case against the ministry following the revelation of the nominees for the said positions in government.
Justice Onyango said that the CS had decided to pick the candidates in a unilateral manner, which should not have been the case.
“This court is convinced that the balance of convenience favours the granting of conservatory orders. As such this court suspends gazette notice No. 6657 of 18th July and issues a temporary injunction prohibiting the respondents or their agents from giving effect to the gazette notice until the case is heard and determined,” Justice Onyango ruled, as quoted by Standard.
Mucheru had named; Jackson Kiprotich Kemboi, Laura Chite, Mahmoud Mohamed Noor and Paul Muraguri Mureithi to join the board before the activist sought legal redress over the same.
