The Employment and Labour Relations court on Thursday suspended the hiring of the Independent Electoral and Boundaries Commission (IEBC) Chief Executive officers. While delivering her ruling Justice Hellen Wasilwa said that the advertisement of the position had some queries.
She called for the reviewing of the ad before the recruitment process can continue as planned.
According to Wasilwa, the advertisement included some provisions that have not been stated in the law as far as the recruitment of the CEO is concerned.
She noted that Section 10(2) of the IEBC Act is self-explanatory on the procedure to recruit the CEO and there is no subtraction or addition required.
IEBC Chairperson Wafula Chebukati had published a notice showing the interested candidates to apply Wednesday, January 31, 2019.
One Mr. Henry Mutundu filed a case against the commission, arguing that it had flaunted the laws of advertisement of the position.
Mutundu, a voter in Masinga, Machakos County, said that the IEBC act doesn’t state that the candidate needs 15 years’ experience as outlined in the advertisement.
He also opposed the stipulation for the candidates to pass a security clearance process, arguing that it was not a requirement for the post of CEO. The candidates who were scouting for the position will now wait longer for the interviews.
