Machakos Governor Alfred Mutua and former Kathiani MP Wavinya Ndeti will on Friday know their political fate as the Supreme Court delivers its ruling on the August 8, 2017, Machakos gubernatorial election.

Mutua has maintained that he won the seat fairly.

He insists that his win reflects the will of the people of Machakos. 

Mutua had criticized the Court of Appeal for nullifying his election, arguing that it’s a case of democracy on trial.

The county boss, through his lawyer Kioko Kilukumi, admitted that there was a slight deviation in the tallying process, but maintained that it doesn’t change the outcome of the election in any way.

Kilukumi told the court that signing of the electoral forms doesn’t change the results.

He pleaded with Chief Justice David Maraga and Justices Njoki Ndung’ u, Isaac Lenaola, Mohamed Ibrahim and J.B. Ojwang to uphold Mutua’s win in the last general election. 

The court's outcome in the ruling will influence the region's politics.

The residents are likely to prepare for a by-election if Mutua loses his seat. 

A win at the court will also propel Mutua as he seeks to ascend to power in 2022 polls.

Both Mutua and Ndeti are confident that they will emerge victorious.
