Speaking to journalists after his release, Malala alleged that detectives from the office of the Director of Criminal Investigation took him to police cells without telling him the reason behind the move yet he is a law-abiding citizen.

“I was arrested without being told anything. I came to this police station and I didn’t know what I had done and even in the OB I didn’t know what they had booked me for,” he said in part.

However, a video showing officers arresting him revealed that he was informed on the reason behind the move

One of the officers, whose identity remains unknown,  told the senator that he was being taken to record the statement over his alleged role on what has transpired in Matungu, Kakamega County.

During the incident, the senator asked why the same officers were always arresting him. He even said that if he is found dead, the police officers should be questioned.

The senator has since said that he will sue the Inspector General of Police Hillary Mutyambai and Interior CS Fred Matiang'i over what he termed as unlawful detention and mistreatment by the police.

He has insisted that he is innocent and no amount of intimidation will make him change his tune as far as fighting for the rights of his people is concerned.
