Two police officers from Mariakani police station in Kilifi County are expected to appear before Malindi law courts on Tuesday, February 12, 2019, to take plea over murder.
This is after Judge Weldon Korir issued a warrant of arrest against the two police officers as requested by the office of the Director of Public Prosecution.
Babra Zombo, prosecution counsel succeeded in convincing the court to issue the warrant against Simeon Oyoo Ayodo and Amos Kiptoo Kipsang who are accused of killing a youth at Kaloleni, in Kilifi County.
“A warrant of arrest has been issued against the accused persons as prayed, mention will be on 12th February 2019 to confirm compliance,” reads Judge Korir’s statement, on Monday, January 28.
They are accused of killing Katana Kaungu on June 26, 2018 at Tsangatsini in Kaloleni Sub-county within Kilifi County.
The prosecution moved to the Malindi High Court after the Mombasa High Court said that the matter should be filed at the court.
In her statement, Ms. Babra said, “we pray for a warrant of arrests against Simeon Oyoo Ayodo and Amos Kiptoo Kipsang who are police officers attached at the Mariakani police station so that they can be brought to court to answer to the charges and the Kilifi County Criminal Investigation Officer to execute the arrest.”
The DPP had written to the court requesting for the arrest of the officers over the murder.
“This matter was initially requested before the High Court in Mombasa however, the court referred that the matter be requested in Malindi. I have attached the order for perusal and records,” stated a letter to the Malindi High Court by Alice Mathangani of the office of DPP.
The letter which was also copied to the Independent Police Oversight Authority (IPOA) further stated that the move was to ensure that the accused persons are produced in court to take a plea.
