City Lawyer Donald Kipkorir has called for the sacking of Chief Magistrate Francis Andayi for the bail ruling that he delivered in the case of Embakasi East Member of Parliament Babu Owino.
The legislator who is accused of shooting a DJ at B club in Kilimani area, Nairobi was freed after Magistrate Andayi granted him a cash bail of Sh10 million that was to be paid in four instalments.
The first instalment of Sh2.5 million was to guarantee Babu Owino his freedom.
Lawyer Kipkorir on Monday nonetheless claimed that the magistrate had gone against the law in his ruling.
According to the Kipkorir, Andayi's directive for the bail money to be used in paying for the hospital bill of the victim of the shooting could not stand water.
The lawyer further claimed that the magistrate had displayed incompetence in his ruling.
"If it is really true that the Trial Magistrate in granting bail to #BabuOwino, ordered that the bail money be used to pay the hospital bill for DJ Evolve, then that ruling can’t stand & the Magistrate has to be sacked for unmitigated incompetence. It is North Korean jurisprudence," Kipkorir's statement on Twitter read.
The family of DJ Evolve, who was allegedly shot by Babu Owino, had earlier on opposed the release of the MP on bail.
