Estranged Migori Governor Okoth Obado is now free to access his Rapogi home in Uriri besides visiting Homa Bay County, High Court Judge Jessie Lessit has ruled.
In October last year, Justice Lessit, among others, banned Mr Obado from coming within 20 kilometers radius to Homa Bay County as part of bail conditions, a ruling that technically banned him from visiting several regions in Migori.
Mr Obado and his two aides, Michael Oyamo and Caspal Obiero, are accused of murdering university student Sharon Otieno and hey unborn child. Mr Okoth was Sharon's boyfriend.
In an application to court filed by lawyer Kioko Kilukumi, Obado argued that the condition was harsh since it bans him from serving as a governor to the people of Migori.
“As such it is impracticable for the accused to effectively discharge the constitutional mandate as the Governor of Migori County,” reads the application, involving a case where Obado is charged with the murder of Rongo University student Sharon Otieno.
But on Tuesday, Lessit overturned her own ruling, saying that it has so far served it's purpose. She said the governor can now access all regions within Migori and Homa Bay Counties. The ruling was meant to curb an possible witness intimidation.
On Friday, Obado failed to accompany Raila Odinga to Awendo constituency, citing the harsh court ruling as the major reason. Mr Odinga was presiding over construction of a new KMTC.
"I cannot be able to travel to Awendo. I am serving a court ruling that could put me in jeopardy. I would have wished to attend though. The former Prime Minister is welcome to Migori," he told the press.
