The Supreme Court has upheld Bowen Kangogo's election as the Marakwet East Member of Parliament.

In a ruling delivered on Friday, the Apex court dismissed an appeal which had been filed by Sammy Kemboi, a voter in the constituency. 

Kemboi had moved to the highest court of the land after the Court of Appeal sitting in Eldoret overturned a High Court decision to quash Kangogo's election. 

Eldoret High Court Judge Kanyi Kimondo had nullified the election of the Jubilee MP late February last year on grounds that the exercise was marred with massive irregularities and illegalities. 

A three-judge bench at the Court of Appeal comprising of Justices Erastus Githinji, Hannah Okwengu and Jamila Mohammed, however, reinstated Kangogo on July 12, 2018, forcing the petitioner to challenge the decision at the Supreme Court. 

The highest court in the country agreed with the Court of Appeal that Kangogo, a Jubilee MP was validly elected. 

During the August 8, 2017 elections, Kangogo was declared the winner by the Independent Electoral and Boundaries Commission (IEBC) after garnering 14, 812 votes with Linah Jebii Kilimo, an independent candidate getting 13, 845 votes.
