The Director of Public Prosecutions Noordin Haji has vowed to move to the High Court to challenge a ruling by the Magistrates court that granted bond and bail to two suspects charged with former Garissa Finance CEC Idriss Mukhtar’s attempted murder.
The DPP through Senior Prosecution Counsel Solomon Njeru says that the decision by the magistrates court to grant bond and bail to Mohamud Hussein Aden and Juliet Njoki is a security threat to Mukhtar’s life.
Mr Njeru says that the accused persons are likely to interfere with investigations, witnesses and even harm Mukhtar who is fighting for his life in Intensive Care unit (ICU) at the Nairobi hospital.
“We are definitely going to make an appeal in the High court to challenge the orders given out by the Magistrates court,” he said on Tuesday at the Milimani Law Courts.
He claimed that the two accused persons are lethal and should have been detained pending the hearing and conclusion of the case.
Milimani Chief Magistrate Francis Andayi released Mohamud Hussein Aden and Juliet Njoki on Sh1 Million bond or alternative cash bail of Sh500, 000.
While granting the bond terms, the Magistrate ordered the accused persons to deposit their passports in court.
The former Garissa CEC is fighting for his life at Nairobi Hospital Intensive Care Unit (ICU).
Garissa Governor Ali Korane is among people who were interrogated in relation to the attempted murder.
