Controversial lawyer and author Dr. Miguna Miguna took on one of Kenya's fine legal minds Dr. Otiende Amollo over his remarks that the National Resistance Movement (NRM) self-declared general did not administer the oath to Raila Odinga during the mock swearing-in.
According Dr. Otende Amollo the oath was self administered and Miguna should not misinform the public by taking credit as the administrator of the oath.
The NRM general took a swipe at Dr. Otiende with a chilling sarcastic response; "oaths don't administer themselves," he replied.
The Rarieda Member of Parliament argued that there was a difference between "administering" and "witnessing," and according to law and principle, Miguna only played the role of a witness and not an administrator.
However, the fiery Miguna came with all guns blazing at Otiende Amollo with constitutional rhetorics.
In one of his tweets responding to the MP, Miguna referred to the explanation as "nonsense, with no legal background,"
"Nonsense Otiende, one of the duties of a commissioner for oaths and/or notary public is to administer oaths and affirmations, which are solemn premises of truthfulness made by a signer or witness," reacted Miguna.
He argued that in the mock swearing-in, Raila was the oath taker and witness while he played the role of a commissioner for oaths.
Miguna referred to Otende's argument as one that is corrupted by the influence of the handshake and should not be taken seriously insisting that he was the only one who was bold enough to administer the oath.
Otiende was responding to the narration by Dr. Miguna Miguna in his book " Treason" that suggests that the author(Miguna) took center stage in necessitating the mock swearing-in ceremony by taking on a treasonous role that led to his arrest and deportation.
