Three Members of Parliament (MPs) have today survived petitions challenging their wins in the August 08, 2018 general elections.
The three leaders survived after the Court of Appeal in Kisumu declared that they were elected fairly.
Led by Justice Fatuma Sichale, the three-judge bench threw out cases challenging election of Shinyalu MP Justus Mugali Kizito, Luanda MP Christopher Omulele and Ikolomani MP Bernard Shinali.
The case against Kizito was filed by former MP Silverse Lisamalu Anami and Adrian Mambili Meja.
The case against Omulele was filed by Arthur Kibira Apungu while Bernard Shinali’s win was being challenged by Butichi Khamisi.
Later, the appellate court nullified the re-election of Homa Bay Governor Cyprian Awiti.
Governor Awiti had moved to the Court of Appeal after the Homa Bay High Court nullified his win in February this year.
The initial case was filled by Joseph Oyugi Mangwanga who was Awiti’s main rival during last Augusts’ general elections.
Justice Fatuma Sichale who read the ruling on behalf of a three-judge bench annulled Awiti’s re- election on grounds that the poll was marred with irregularities.
The Judge ordered Awiti and the Independent Electoral and Boundaries Commission (IEBC) to pay Sh4 million and Sh2 million respectively to former Kasipul MP Oyugi Magwanga as costs of the case.
