Garissa Governor Ali Korane now wants the High Court in Nairobi to throw out a case challenging his academic qualifications.

Korane says the petition challenging his academic papers filed by Adan Mukhtar Barre lacks merit.

The Garissa Governor through his lawyer Ahmednasir Abdikadir further claims that the petition is malicious and based on personal opinion and not facts.

Korane now wants to be given 30 days to file a replying affidavit to the petition.

“We intend to file a replying affidavit to have this petition struck out or the court to give us 30 days to respond to it,” Korane’s lawyer said in court on Wednesday.

However, Nairobi High Court Judge Wilfrida Okwany declined to dismiss the petition.

Justice Okwany instead asked parties involved in the petition to file and serve responses before the hearing on December 19, 2018.

Last week, Adan Mukhtar who is the father to former Garissa Finance Executive Idriss Mukhtar, filed a petition seeking Korane’s removal.

Mukhtar claims that Governor Korane is in office illegally.

He argues that that the governor allegedly used fake academic papers to contest for the seat.

Mukhtar alleges that his son ’s attempted murder is a result of Korane’s alleged fake papers.

He argues that his son who is fighting for his life in ICU had filed a case challenging Korane’s papers in court.

Idriss survived an attempted assassination on August 19 and is receiving specialized treatment in India.

Korane has denied involvement in Idriss attempted murder.
