Embakasi East MP Babu Owino is set to be charged with causing grievous bodily harm on a voter during August 8 polls.
He will also face another election-related charge that he allegedly committed during the campaign period in Embakasi East.
Owino was re-arrested on Wednesday, moments after being released on a Sh500,000 cash bail in his case of subversion, insulting the President and incitement.
He spent the night in Pangani police cells.
The first-term MP known for controversy made an apparent reference to President Uhuru Kenyatta as 'mtoto wa mbwa'.
The opposition has condemned the re-arrest of Owino.
The opposition has accused the government of resorting to torture tactics.
NASA has also asked the President to not use the courts to intimidate leaders.
The National Cohesion and Integration Commission has ruled out charging Owino.
