A minor has told a Kangundo Law Court that the man who allegedly defiled her offered her a ride to school.
Testifying before the senior resident magistrate, Martha Opanga on Wednesday, the 17-year-old form two student said the accused Adams Mbithi was a close friend of her elder brother and was well known to her.
"Adams came to our home and offered to take me to school on his motorbike. On the way, he asked to have sex with me and he diverted to one of his friends home where we had sex and proceeded to school thereafter," the minor stated.
During the hearing conducted in camera, the minor told the court she noticed she had forgotten her keys at the home where she sex with the accused person, prompting them to make another trip to the home.
"Unfortunately, we got there and found the house we had slept in had been locked by the owner. We again proceeded to school and on arrival, we discovered my parents had made several calls enquiring on my whereabouts," she said.
The minor's mother who also testified in the case gave a concurring testimony that the accused person was a good friend of her son.
"My daughter informed me that the accused person and herself went to a friend's home where they had sex," the victim's mother told the court.
A teacher at the school where the minor studies told the court the school administration handed over the matter to the police after a clinical examination at a nearby health facility revealed the girl had been defiled.
"Both the accused and minor lied that the motorbike broke down on their way to school but we took her to a nearby clinic where she was examined and confirmed she had had sex that day," said the teacher.
The defendant who was present throughout the hearing has denied committing the offense.
It is alleged he committed the offense on January 3, 2018 at Kisukioni village in Matungulu, Machakos County.
The case will be heard on June 28, 2018.
