Activist Okiya Omtata is at it again, this time round moving to court to stop President Uhuru Kenyatta's Cousin Beth Mugo and Eldas Mp Aldan Keynan from assuming offices as parliamentary service commissioners.
According to Omtata, Mugo and Keynan had already served their mandatory term of five years each at the helm of parliamentary service commission.
"No provision in the Constitution allows any PSC commissioners to serve for more than five years and having been in the previous PSC, their nomination and subsequent approval to serve beyond five years was unconstitutional, invalid, null and void,”Omtatah was quoted by The Standard.
The activist on his admission said that he was not in anyway driven by political interest but the need to respect and uphold the constitution and the rule of law by everybody.
Omtata argued that Parliament failed to respect and uphold the Constitution by allowing Mugo and Keynan to continue being commissioners when in essence they had finished their terms adding that he wants the court to temporarily suspend the two until the case is heard and determined.
"It is of utmost importance that the decision to approve the nomination of Senator Mugo and Keynan be suspended to protect constitutionalism, the rule of law and public interest,” he said.
Parliament last week approved Kericho Senator Aaron Cheruiyot and Taveta MP Naomi Shaban as Jubilee party nominees while Malindi MP Aisha Jumwa, Borabu MP Ben Momanyi and Vihiga Senator George Khaniri from NASA were also approved to serve in the prestigious PSC.
