A petition involving the Independent Electroral and Boundaries Commission (IEBC) submitted to the High Court ahead of the August 8 election was submitted on Tuesday.
Gladwell Otieno has asked the court to enforce the IEBC to make the voter register available to the public citing a lack of consistency in the amount of registered voters.
"There are noted inconsistencies in numbers declared by IEBC. It is only fair and just the actual status is ascertained," she says in her filed application as reported by The Star.
Gladwell further asked the court to prevent IEBC from distributing the register prior to examination.
"It will be fair and just to allow the register voters to be subjected to public inspection...This will enable the applicant to ascertain the actual number of registered voters in affected regions," she said.
Gladwell cited Section 6 of the Election Act which demands for the examination of the register 90 days prior to the elections.
Despite Otieno's efforts the IEBC has not published the register and believes that the act risks a just and transparent election.
"The continued non-observance of provisions of the law constitute a threat to the rights and freedoms for a free and fair election," Otieno stated.
