High court advocate Kethi Kilonzo is now seeking for the termination of her ongoing elections fraud case.
Kethi alongside her co-accused Godfrey Ninito Lemiso have reached out to the new Director of Public Prosecution (DPP) Noordin Haji to have their cases terminated on the grounds that they did not commit any offense as alleged.
The duo was charged in September 2013 with stealing Independent Electoral Boundaries Commission (IEBC) acknowledgment slip between November 19, 2012, and June 27, 2013.
The national electoral agency had taken a position that only the DPP has the powers to convince the court to do away with the ongoing suit.
The appeal comes even after a warrant of arrest was issued against Ninito for failing to present himself in court over the fraud case.
The failure of Ninito to appear for the case saw Milimani Court Chief Magistrate Francis Andayi directing the case to be adjourned since it could be handled in his absence.
Kethi, the daughter of the late Makueni Senator Mutula Kilonzo used Sh5 slip to prove that she was registered as a voter at Ngong Forest Primary School in Nairobi County.
The renowned lawyer has been put on the spot for allegedly handling stolen property as well as presenting false documents to IEBC returning officer Salad Boru in Wote, Makueni County she sought to replace her late father, a position which was later taken by his brother Mutula Kilonzo Junior.
