The attorney general‘s office is yet to file a response in the case about the flopped free Wi-Fi project in Nakuru town, the high court heard yesterday.

Lawyer John Githui, for the Counties Efficiency and Development (Cedev), and Nakuru East MP David Gikaria told Lady Justice Janet Mulwa that the AG, who was expected to file a response about the collapsed project was yet to do so.

AG Githu Muigai had sought for more time previously to file his response in court about the allegations of extensive use of public funds in the unsuccessful free Wi-Fi project.

The court had granted him 30 days to table the evidence, but according to Githui, the AG’s office had not done so by yesterday when the case came up for mention, a fact he said might take the case in a circus.

The judge directed parties in the case to seek a date from the registry when they will make their submissions in court.

The petitioners want the court to order the county government and the AG's office to provide them with copies of the contract between the county government and the entity contracted to install the Wi-Fi.

A petition was filed in June by three petitioners accusing the Nakuru County government and the State House Digital team of failing to provide a breakdown of the Sh300 million, allegedly used in the installation of the project.

The county government has distanced itself from the project. Through written submissions filed at the court, Nakuru County has denied participatory cost in the failed project.

The county government claimed it was only hosting the roll out of the Jubilee administration project which is part of its manifesto.
