[Photo|zipo.co.ke]Attorney General Githu Muigai has given Nasa leader Raila Odinga a tough warning against his planned swearing-in as President slotted for next week on Tuesday.Githu has warned that NASA leaders will face the wrath of the State if they carry out the audacious plan."NASA will be violating Constitution Article 3(2), obligating everyone to uphold and respect the Constitution. Any attempt to establish a government otherwise than in the compliance with the constitution is unlawful and an offence. The law is as clear as day and night," Muigai told the Star on Tuesday.NASA has, however, been citing Article 1 that gives all sovereign power to the Kenyan people, as justification to swear in Raila as the People's President.According to the Star, the National Intelligence Service has recommended NASA leaders be arrested and charged with treason if Raila is sworn in.The Penal Code says anyone who tries to form a government contrary to the Constitution could face charges of sedition, undermining a legitimate government and treason, which is punishable by death.In 1982 several people were arrested and charged with offences including treason for attempting to overthrow President Daniel Moi in a botched coup. Raila was arrested and detained for close to a decade.Despite warning from the government, Raila and allies remain defiant and are charging ahead with plans to swear him as the People's President in the National People's Assembly.
