The attorney general, Githu Muigai through his lawyer, Peter Wena has withdrawn his application which he had moved to the Ccourt of Appeal to have the Judicial Service Commission (JSC) compelled to present the names of the 3 shortlisted candidates for the chief justice post to the president for him to pick one of them whom he prefers.
The application which was made on the June, 23 brought him under sharp criticism and condemnation from both the Law Society of Kenya (LSK) and the commission accusing him of sneaking in the application.
The withdrawal has been accepted by the Appellate judges, Patrick Kiage, Jamilla Mohammed and Gathembu Kairu who have allowed it on a condition that the AG pays the costs of the motion to the interested parties.
According to senior counsel, Tom Ojienda who also represents LSK, they had suspicions and suspected foul on how the application was admitted in the court of appeal and fast-tracked for hearing further saying that there could be a difference in thinking and ideologies among the stakeholders on the best way of acquiring the next chief justice and her deputy but the law must be followed.
