The sons of slain drug baron Ibrahim Akasha and two foreigners on Thursday filed an application before a Mombasa High court seeking to have their bond term reassessed.
The accused persons through their defense lawyers urged the court to lower the bond since they were cooperating with the orders given.
In the case, Mr Baktash Akasha Abdalla and his brother Mr Ibrahim Akasha Abdalla are accused of allegedly being involved in the trafficking of 98 heroine packets in 2014.
The brothers were charged alongside two other suspects, Mr Gulam Hussein and Mr Vijaygiri Anandgiri Goswani.
Following an appeal by the Director of Prosecutions to increase the bond terms, Justice Martin Muya ordered for the accused persons to be released on a Sh30 million bond each.
Justice Muya also ordered the suspects to report to the police thrice a week, and further ordered police to detain the identification cards and passports of the suspects until the case is heard and determined.
Lawyers, Cliff Ombeta, Kirathe Wandugi, George Wajackoyah and Leila Latif want the court to reinstate orders made by a Magistrate Court which released them on a Sh5 million bond, and also allow the accused persons to report to police only once in a week, arguing that their clients were cooperating with the orders given.
Assistant Director of prosecution Alexander Muteti however opposed the application and asked the court to dismiss it, saying the court was not in a position to cancel orders made by the high court.
“We welcome them in the court of appeal if they wish and not in this court,” said Muteti.
Lady justice Dorah Chepkwony ordered for the case to be heard on November 25 when she will make her ruling.
