Controversial blogger Robert Alai has faulted High Court Judge Chacha Mwita’s ruling on self-declared National Resistance Movement (NRM) general Miguna Miguna’s deportation.
Alai argued that Justice Mwita should not have ordered Miguna to be allowed to return to the country using his Canadian passport.In a tweet on Monday, Alai opined that the judge erred in the ruling by involving the Canadian passport clause, adding that he believes the ruling should have just entailed the facilitation of Miguna's re-entry into the country. "You order that Miguna even be allowed on a Canadian passport but is it a must that he be given a VISA? The judge just messed his order with the Canadian passport clause. Should have just ordered that his re-entry be facilitated," read Alai's tweet.In his ruling on Monday, Justice Mwita said Miguna can use his Canadian passport to return to the country, adding that can return on a date he chooses.The judge also suspended a directive by Interior CS Fred Matiang’i declaring Miguna a non-citizen.This comes after the government appealed a ruling by Judge Luka Kimaru that declared Miguna’s deportation illegal.Miguna was deported to Canada for his involvement in the swearing-in of NASA leader Raila Odinga as the people’s president on January 30.
