Although the Supreme Court failed to find IEBC chief Ezra Chiloba criminally culpable, he is not yet off the hook, insists lawyer James Orengo.
Chiloba is under pressure to quit from the poll agency over illegalities and irregularities committed in the nullified presidential elections.
And lawyer James Orengo says the CEO should take responsibility as the custodian of the commission adding that the Supreme Court findings warrants criminal prosecution.
“We have evidence that is before us and the fact that the commission committed illegalities, it’s now upon the DPP to take up the case soonest.
“If he fails to initiate criminal proceedings, we shall now pick the case and proceed with private prosecution,” added Orengo.
In a rare interview weeks after the bungled elections, a defiant Chiloba maintained that he conducted the ‘best’ elections in the world.
Also among the things NASA has listed as irreducible minimums include cancellation of printing tender awarded to Al Ghurair and transmission tender taken by OT – Morpho of France.
