The increasing numbers of shisha lovers in Nairobi have been dealt another blow after the High Court declined to suspend an earlier ban imposed on Thursday by Health CS Cleopa Mailu.
This was after fifteen people comprising smokers, distributors, and manufacturers of shisha filed an urgent application at the High Court protesting against the ban.
They argued that the decision to ban the importation, sale, advertising of shisha was irregular and must be lifted before the matter is heard and determined.
But Justice John Mativo on Friday declined the request saying he could not give any orders until all parties in the case are heard.
He instead allowed the applicants to sue the ministry, CS Mailu and the Attorney General, and said the three parties must be served with suit papers immediately.
In Nairobi, shisha smoking has been gaining popularity especially among ladies of the working class.
