Human rights activist Okiya Omtatah has moved to court to challenge the appointment of Nominated Senator Beth Mugo and Eldas Member of Parliament Adan Keynan as Parliamentary Service Commissioners.
According to Omtatah, the two have served beyond the one term allowed in law.
“The approval of the two to serve beyond the limit of five years is expressly unconstitutional and, therefore, invalid, null and void ab initio,” Omtatah argues in court papers.
Omtahtah further says that no provision of the Constitution expressly allows MPs who are also commissioners of the PSC to serve for more than one term of five (5) years.
The activist further argues that Parliament has threatened and violated specific provisions of the Constitution and the law.
He sayd the move now undermines constitutionalism in general and the rule of law in particular.
He now wants the court to suspend the appointment of the two.
