The ODM MP was arrested after disrupting voting process at Bomu primary school, which had been made a polling station by the ODM party to conduct nominations in Mombasa County.

Mwinyi accused ODM Deputy Party Leader, Mombasa Governor Hassan Joho of plotting to rig him out in favour of Goshi Juma who was his close opponent, claims Juma denied.

According to Changamwe OCPD Peter Omanwa, Mwinyi was arrested for allegedly causing disturbance and destruction of property at Bomu primary school.
