A Nakuru court has ordered Mandera police boss to arrest a police constable involved in an inquest into a defilement case pending at the court.

Senior resident magistrate Judicaster Nthuku ordered the OCPD to arrest police constable Osman Mohammed, who is currently attached to his division. Prosecution officer Samuel Kamau told the court that failure by the officer to attend court has derailed the case and urged the court to issue a warrant of arrest.

However, when the case came up for hearing on Monday the prosecutor prayed for yet another adjournment of the two-year-old case, saying the investigating officer has failed to appear in court. The officer was investigating the crime allegedly committed by Nathaniel Njuguna on February 2012 at Ndeffo farm in Njoro area before he was transferred to Mandera.

Njuguna, who was present in court, pleaded for his case to be dropped saying he has suffered in custody for long.

“I have continued to suffer inside the prison and the case is being adjourned every time of the hearing. It appears the investigating officer will never step in this court,” Njuguna pleaded.

The magistrate granted the last adjournment before issuing the arrest warrant against the police constable. Njuguna, who denied the charges, is remanded at the Nakuru GK prisons.

Hearing will continue on August 26.
