Paul Ongili alias Babu Owino has maintained that he won the Embakasi East parliamentary seat after the High Court nullified his election on Friday.
Judge Joseph Sergon in his ruling said that errors identified in the parliamentary election were widespread and ordered for a fresh election.
Speaking after the ruling, Owino said he will appeal the ruling.
“I know very well that the government colluded with the judge to ensure I lose the petition. I am strong, I will beat my opponent again,” he said.
Owino was declared the winner in the August 8 elections with 46,587 votes against Francis Mureithi's 42,253.
Mureithi challenged the outcome and Judge Sergon ordered the repeat count saying his reasons were sufficient.
The recount results indicated that Owino, who vied in an ODM ticket, got 46,817 votes against the 42,501 his closest competitor Francis Mureithi of Jubilee Party garnered.
The report, signed by High Court Deputy Registrars Esther Mburu and MbayaKi Wafula, says the scrutiny and recount was a success, except for an incident where one of the deputy registrar’s phones was stolen.
