The High Court in Nairobi has declined to lift a licence ban imposed on a matatu Sacco whose crew clobbered a motorist at Zimmerman last year.

Marimba Investments Sacco's license was banned by the National Transport and Safety Authority (NTSA) following the death of Joseph Kiarie, a former Maseno University student leader.

Justice Roselyn Aburili ruled on Wednesday that the Sacco failed to exhaust the available internal mechanisms before going to court.

NTSA told the court that the matatu driver who killed Kiarie was still at large.

Meanwhile, two Marimba Investments Sacco touts suspected to have killed Kiarie were arraigned in court on Wednesday to face murder charges.

George Irungu Maina and Ian Mbugua are suspected to have killed the motorist on December 24.

The two did not plead to the charge since they did not have a lawyer when they appeared before High court judge Jessie Lesiit.
