Bartered Jackline Mwende's case in which her husband is the defendant failed to proceed as scheduled due to failure to present the witnesses in the same case by the prosecution.
The estranged husband Stephen Ngila faces charges of violence and possibly attempted murder; having chopped off Mwende's over infertility claims.
The prosecution argued that Mwende who is the complainant, as well as the key witness in the very case would undergo treatment for three months and presented a letter from PCEA Kikuyu Hospital to back up the argument.
“This 27-year-old lady who is under our care for traumatic amputation of both forearms is still undergoing treatment awaiting prosthetic limbs. The treatment will continue for another three months after acquiring the myoelectric limbs,” noted the letter presented by the prosecution.
The defendant through his lawyer Moses Kamolo opposed the prosecution's claims to have the case postponed until the complainant is fully recovered saying that Mwende had already been discharged from Hospital on August 27.
He further argued that the prosecution was delaying the case unnecessarily noting that it should present the rest of the witnesses in Court even in the absence of Mwende.
As per the ruling of Machakos resident magistrate Kipkurui Kibellion, the case is set to continue on September 27, 2016.
