After hours and hours of the three judge appellate bench including Justice William Ouko, Agnes Murgor and Patrick Kiage deliberations on NASA appeal to have presidential results announced by the constituency returning officers, the verdict is out with NASA team all smiles.
IEBC, had taken the case to the court of appeal after the High Court okayed the move two months ago.
IEBC had a standpoint that the presidential votes were to be announced by the the commission chair but NASA team wanted the votes to be announced by the constituency returning officer and that the announcement be declared final without any more rectifications.
The appellate judges thus said the constituency returning officers are by law mandated by the constitution to announce presidential tally which should not be altered at the national tallying center."Presidential results to be declared at the constituency level by the returning officer," said the three Judge bench.
The head of NASA legal team lawyer Paul Mwangi has said they are satisfied by the court of appeal ruling.
