A court has warned the prosecution in the child theft case involving Bishop Gilbert Deya against delaying the hearing.
In August, Deya was charged with stealing five children aged below 14.
State counsel Nicholas Mutuku asked the court to interpret its ruling over the hearing dates.
He said the court had ordered the case to be heard daily starting October 9.
The High Court had directed that the case be heard and determined in not more than 120 days.
Mutuku wanted an interpretation on whether or not the case will be heard at weekends and public holidays, including the day for elections October 26.
Lawyer Fred Ngatia requested the court not to allow the prosecution side the opportunity to keep his client in custody by delaying the case further.
While giving his ruling, chief magistrate Francis Andayi ordered that the case proceeds for hearing on a day-to-day basis starting Monday (yesterday).
