The High Court in Homa Bay on Tuesday morning nullified the re-election of area Governor Cyprian Awiti, a close ally of his party leader, NASA leader Raila Odinga.
This is after his closest opponent in the August 8, 2017 general elections Oyugi Magwanga successfully petitioned the election citing massive election irregularities.
Judge Joseph Karanja ruled that IEBC did not conduct a free and fair election and ordered for another gubernatorial election.
"The declaration by IEBC of the 3rd respondent as the governor of Homa Bay has now been invalidated," he said.
He indicated that the respondent pays Sh6 million petition costs.
Awiti who vied on an ODM party ticket, becomes the second governor to lose his seat after nullification of Wajir Governor Mohammed Abdi early January 2018
