The High Court in Kisumu began hearing a petition challenging the election of Prof Anyang Nyong’o as governor.The petition, filed by former Kisumu Governor Jack Ranguma seeks to nullify the election of Prof Nyong’o citing electoral malpractices.The petitioner’s first witness Jack Odera who was also the campaign coordinator told the court that about 300 forms 34A and 34B he examined had discrepancies.However Odera was put to task to explain to the court where he obtained the forms in question and how he arrived at the figures showing malpractices.The Independent Electoral and Boundaries Commission (IEBC) lawyer Edwin Mukele said it was not possible to ascertain how Odera got the forms and figures since in his sworn affidavit there was no document to prove that he was indeed the petitioner’s campaign coordinator or agent.The figures contested, he added could not be authenticated since the witness did not present any qualifications before the court to prove that he was a statics expert thus casting doubt on his evidence.Appearing before High Court Judge David Majanja, Odera defended himself saying he was duly appointed as the campaign coordinator for Jack Ranguma and he received the forms from agents who were deployed across the county.Nyong’o’s lawyer James Orengo further questioned the qualifications of the first witness asking him to clarify whether he was giving evidence as an IT expert or a layman.He questioned the witness’s qualifications on ICT and analyzation of data as presented in his two affidavits.Odera told the court Tuesday, that the information contained in his affidavits was obtained from agents, IEBC portal, server and the voters register.
