President Uhuru Kenyatta’s responses over the ongoing Supreme Court case challenging his reelection received a major blow following the decision by the court to refuse expunging of a number of affidavits filed by the petitioner.
In his prayers through lawyer Ahmednassir Abdullahi, Uhuru claimed that the affidavits were filed late hence could prejudice his rights as respondent.
In their ruling on Sunday night, the Supreme Court judges allowed admission of the affidavits arguing that expunging them could sabotage the petition hence lead to collapsing of the case.
Counsel Fred Ngatia on Saturday had claimed that the additional affidavits amounted to new evidence contrary to court traditions which disallows additional of new evidence that changes the dynamic of the case.
The latest development means that Uhuru and his team will have no choice other than filing various responses to claims raised by the opposition team.
The country will know the fate of the presidential petition on Friday when the constitutional time limit of presidential petitions elapses.
