The High Court in Machakos has revised it's earlier order to store materials used in the August poll.Hearing Wavinya Ndeti's petition against Governor Alfred Mutua, the court reconsidered its initial orders citing lack of space.The materials and boxes are currently stored at the IEBC's county office. "As you may recall, the court ordered on September 24 that the IEBC brings all election materials to court but when the registrar visited, she discovered that they were too many for the space in court," Ndeti's lawyer Otiende Amolo told journalist on Wednesday."We noticed that some boxes are in bad condition," Otiende said.On October 18, the court will rule on whether the case will continue to full trial. The electoral commission had applied to have the case struck out as it was not filed within the legal period.
